1. GENERAL SESSION - COUNCIL CHAMBERS PLAZA LEVEL - 7:00 P.M.

1.A. Call to Order/Roll Call

Mayor Marick called the General Session to order at 7:02 p.m., all members were present.

1.B. Pledge of Allegiance: Boy Scout Troop 707

Boy Scout Troop 707 led the Pledge of Allegiance.

1.C. Invocation: Pastor Doug Green, North Hills Church

Pastor Doug Green, North Hills Church, delivered the Invocation.

1.D. Report - Prior Study Session

None.

1.E. Community Announcements

Council Member Vargas invited the community to join the City of Brea for the annual Spring Craft Boutique. He indicated that the two-day event will be held on March 15 and 16 at the Brea Community Center, noting parking is free and admission is $3.

Council Member Hupp invited the community to join Brea Fitness in promoting a healthier community at the City of Brea Health & Wellness Expo on May 11 at the Brea Community Center. She indicated that exhibitor opportunities are now available, and directed interested participants to email email health.wellexpo@cityofbrea.net for more details.

Mayor Pro Tem Stewart announced that the Brea Resource Center is hosting a Child Parent Training class beginning March 12 where parents can learn: effective communication techniques, positive discipline strategies to nurture child's development, and proven methods for building strong parent-child relationships. He stated participants may register at BreaRec.com.

Council Member Simonoff announced that there is still time to register for the "Engage Brea, Understanding Your City" community engagement program. He explained that the program is a great way to connect with local City government and better understand how it functions. He indicated that participants will receive a general overview of City operations, departments, and external agencies, and that the eight-week program will meet on Thursday evenings, beginning March 21 through May 2. Lastly, he announced that registration closes on March 18 and directed residents to visit the City website for more information. 

Mayor Marick announced that Love Brea takes place on  Saturday, April 27, and stated that Love Brea is a great opportunity to serve and donate time to the community by volunteering for service projects. She indicated that project submissions are now open and the City is looking for projects that can be completed within a 2 to 3-hour window. She encouraged the community to submit project ideas online at LoveBrea.org, and noted that donations and sponsors are also needed to help fund service projects and Love Brea.

1.F. Matters from the Audience

Sean Thomas thanked the Public Works Department and Mayor Pro Tem Stewart for their assistance in cleaning up graffiti on the trails. He also spoke about coyotes on the trails.

City Manager Gallardo responded to public inquiries.

2. PUBLIC HEARING

2.A. Zoning Ordinance Text Amendment No. 2023-04: Omnibus Code Update Amending Various Chapters of Titles 12, 18, and 20 of Brea City Code

Senior Planner Newton provided a presentation, spoke about the purpose of the proposed amendments, and provided an overview of the proposed code updates and spoke about amendments related to signs, including temporary signs in the public right-of way and private property; comprehensive sign programs; and flags. She also spoke about amendments related to Accessory Dwelling Units (ADUs), Wireless Communication Facilities, fence and wall heights, and other minor amendments. Finally, she spoke about project noticing, CEQA exemption and staff's recommendation.

Mayor Marick opened the public hearing. Seeing no members of the public wishing to speak on this item, Mayor Marick closed the public hearing.

Council discussed height limits on antennas, previous omnibus code updates, and hedge height and setback requirements. They also discussed the number of flags permitted on private property. Council concurred to amend staff's recommendation on the number of flags permitted on private property in the draft ordinance from two (2) to three (3).

Discussion ensued related to temporary signs in the right-of-way, including political banners on street light poles.

Motion was made by Council Member Hupp and seconded by Mayor Pro Tem Stewart waive full reading and introduce Ordinance No. 1247, An Ordinance of the City Council of the City of Brea Amending the Brea City Code by Adopting Zoning Ordinance Text Amendment (ZOTA) No. 2023-04 (Omnibus Zoning Code Update) and Approving a CEQA Exemption Determination, and schedule adoption of aforementioned Ordinance at the next regular City Council meeting. Motion passed 4-1-0, with Council Member Vargas voting "No"

3. ADMINISTRATIVE ITEMS

3.A. Waive full reading and introduce Ordinance No. 1248, an Ordinance of the City Council of the City of Brea establishing procedures for setting sewer connection fees, and approving a CEQA exemption determination

Financial Services Manager Madrazo provided a presentation and indicated that the ordinance for consideration is to repeal current procedures of adopting sewer connection fee amounts and stated that the new process will be adopted by resolution at the next regular meeting. She indicated that the second reading of the ordinance will not take place until the revised sewer connection fees are adopted, noting they are scheduled to go before a Public Hearing at the March 19 City Council Meeting. She also noted that the ordinance introduced by way of this item will become effective 30 days after the second reading.

Motion was made by Council Member Simonoff and seconded by Council Member Hupp to wive full reading of and introduce Ordinance No. 1248, An Ordinance of the City Council of the City of Brea Establishing Procedures for Setting Sewer Connection Fees, and Approving a CEQA Exemption Determination. Motion passed 5-0-0.

4. CONSENT CALENDAR

Motion was made by Council Member Simonoff and seconded by Council Member Hupp to approve Consent Calendar Items 4A-4F. Motion passed 5-0-0.

4.A. February 20 Regular City Council Meeting Minutes

The City Council approved the February 20 Regular City Council Meeting Minutes as written.

4.B. February 23 Special City Council Meeting Minutes

The City Council approved the February 23 Special City Council Meeting Minutes as written.

4.C. Acceptance of Public Improvements and Release of Improvement Bonds for the AvalonBay Communities Site

The City Council accepted public improvements and authorized the City Clerk to release Performance, Payment, and Monument Bonds; and accepted the Warranty Bond to guarantee the work from defective work, labor, or material performed.

4.D. General Plan Annual Progress Report 2023

The City Council received and filed the 2023 General Plan and Housing Element Annual Report; and directed staff to submit the Housing Element Annual Report to the California Department of Housing and Community Development (HCD) and Office of Planning and Research (OPR).

4.E. Prohousing Incentive Program Grant Application Submission to the California Department of Housing and Community Development

The City Council adopted Resolution No. 2024-011 authorizing the submission of a Prohousing Incentive Program Notice of Funding Availability Round 2 grant application to the California State Department of Housing and Community Development; and authorized the City Manager, or his designee, to execute all documents and agreements necessary to participate in the Prohousing Incentive Program.

4.F. January Outgoing Payment Log and February 16 & 23, 2024 City Disbursement Registers

The City Council received and filed the January Outgoing Payment Log and February 16 & 23, 2024 City Disbursement Registers.

5. CITY/SUCCESSOR AGENCY - CONSENT

Motion was made by Council Member Simonoff and Seconded by Council Member Vargas to approve City/Successor Agency Consent Item 5A. Motion passed 5-0-0.

The City Council, as the Successor Agency, received and filed the February 16, 2024 Successor Agency Disbursement Register.
