1. CLOSED SESSION - EXECUTIVE CONFERENCE ROOM 3RD FLOOR - 6:15 P.M.

1.A. Call to Order/Roll Call

Mayor Marick called the Closed Session to order at 6:15 p.m. All members were present, with Council Member Hupp absent.

1.B. Public Comment-

None.

1.C. Conference with Legal Counsel Pursuant to Government Code Section §54956.9(d)(1)-Existing Litigation. Name of Case: Mark Busch v. City of Brea (Case No. 30-2024-01377628-CU-OE-NJC)-

1.D. Conference with Legal Counsel Pursuant to Government Code Section 54956.9(d)(4) - Anticipated Litigation. Initiation of Litigation: 1 potential case.-

Mayor Marick adjourned the Closed Session at 7:00 p.m.

2. GENERAL SESSION - COUNCIL CHAMBERS PLAZA LEVEL - 7:00 P.M.

2.A. Call to Order/Roll Call

Mayor Marick called the meeting to order at 7:03 p.m. All members were present with Council Member Hupp absent.

2.B. Pledge of Allegiance-

Boy Scout Troop 707 led the Pledge of Allegiance.

2.C. Invocation-

Pastor Eric Clausen, Christ Lutheran Church, led the Invocation.

2.D. Community Announcements

Council Member Vargas announced the Brea Gallery's Annual Made in California Juried Exhibition is now open for submissions. He stated the Brea Art Gallery would like to invite all artists in California, regardless of medium, to enter and participate in this exhibit with an opportunity to win cash prizes, and directed those interested to the City website for more information.

Mayor Pro Tem Stewart announced the City of Brea will be hosting its Veterans Day Ceremony on Monday, November 11 at 10:00 a.m. at the Brea Veterans Memorial located at the Brea Civic and Cultural Center. He invited residents to join the Brea community in paying tribute to all military heroes, past and present, and indicated that more information can be found on the City website.

Council Member Simonoff encouraged residents to participate in the Great ShakeOut on Thursday, October 17 at 10:17 a.m., where millions of people worldwide will participate in earthquake drills at work, school, or home to practice earthquake safety. He noted the Civic Center will be participating, and an AlertOC test will be conducted at the same time. He directed the community to the City website for more information.

2.E. Matters from the Audience

Bianca Stilponi, La Habra resident, voiced her concern about Brea Police Department's patrol conduct and policies.

Sean Thomas expressed concern regarding fire dangers, heli-hydrants, and inquired as to the City's involvement with SOLAR (San Bernardino, Orange, Los Angeles, and Riverside County Mutual Aid Partnership). In addition, he asked about the City's mutual aid partnership with neighboring cities regarding fire response.

Bev Perry spoke regarding political action committees, finances and misleading campaign information.

Glenn Parker expressed concerns over misinformation from campaigns, provided clarification regarding the Integrated Crime Center, discussed the City of Brea's current involvement with SOLAR, and the proposed Tonner Canyon landfill access route.

Denise Eby, City Treasurer, asked the community to support her candidacy in the 2024 General Municipal Election.

Bill Klovstad asked the community to support his candidacy in the 2024 General Municipal Election.

Matthew Harden spoke in opposition to Brea Olinda Unified School District's Ballot Measure H.

Deena Miller, Brea Olinda Unified School District Board Member, spoke in support of Ballot Measure H.

Carrie Flanders spoke in support of Brea Olinda Unified School District's Ballot Measure H.

Glenn Vodhanel spoke in opposition to Brea Olinda Unified School District's Ballot Measure H.

Joseph Covey, read into the record a statement by Dwight Manley, expressing support for Brea Olinda Unified School District's Ballot Measure H.

Tom Donini asked the community to support his candidacy in the 2024 General Municipal Election.

Mayor Pro Tem Stewart and Council Member Vargas responded to public inquires.

3. CONSENT CALENDAR

Motion was made by Council Member Simonoff and seconded by Mayor Pro Tem Stewart to approve Consent Calendar Items No. 3A. - 3G. Motion passed 4-0-0-1 (Ayes: Marick, Stewart, Simonoff, Vargas, Absent: Hupp).

3.A. September 17, 2024 Regular City Council Meeting Minutes

The City Council approved the September 17, 2024 Regular City Council Meeting Minutes as written.

3.B. Annual Mills Act Compliance Report

The City Council received and filed the Annual Mills Act Compliance Report.

3.C. Adoption of Local Hazard Mitigation Plan

The City Council adopted Resolution No. 2024-060 approving the Local Hazard Mitigation Plan.

3.D. Concrete Maintenance Agreement For Removal and Replacement of Sidewalks, Curbs and Gutters throughout the City

The City Council awarded contract to CT&T Concrete Paving, Inc., in the amount of $180,000 for a period of one (1) year; and authorized the City Manager to approve up to four (4) additional one (1) year extensions in the amount of $180,000.

3.E. Accept a $76,870 U.S. Department of Energy – Energy Efficiency and Conservation Block Grant Program Equipment Rebate Voucher

The City Council accepted a U.S. Department of Energy (DOE) - Energy Efficiency and Conservation Block Grant (EECBG) Program Equipment Rebate Voucher, which funds the purchase of energy-efficient equipment for $76,870, for the two-year grant period from June 25, 2024, through June 25, 2026, with an option to request a no-cost extension.

The City Council received and filed August and September Outgoing Payment Logs and September 13, 20, 27 and October 4 City Disbursement Registers.

The City Council received and filed Monthly Report of Investments for the City of Brea for Period Ended September 30, 2024.

4. CITY/SUCCESSOR AGENCY - CONSENT

Motion was made by Council Member Vargas and Seconded by Council Member Simonoff to approve City/Successor Agency Consent Calendar Item 4A. Motion passed 4-0-0-1 (Ayes: Marick, Stewart, Simonoff, Vargas, Absent: Hupp).

4.A. Monthly Report of Investments for the Successor Agency to the Brea Redevelopment Agency for Period Ended September 30, 2024

The City Council, as the Successor Agency, received and filed Monthly Report of Investments for the Successor Agency to the Brea Redevelopment Agency for Period Ended September 30, 2024.

5. BREA ARTS CORPORATION - CONSENT

5.A. Brea Arts Corporation Annual Report for Fiscal Year 2023-24

Motion was made by Council Member Vargas and seconded by Mayor Pro Tem Stewart to approve Brea Arts Corporation Consent Calendar Item 5A. Motion passed 4-0-0-1 (Ayes: Marick, Stewart, Simonoff, Vargas, Absent: Hupp).

Community Services Director Hernandez answered Council questions regarding Brea Arts Corporation funding and filing.

The City Council, as the Brea Arts Corporation, received and filed the Brea Arts Corporation Annual Report for Fiscal Year 2023-24.

Council Member Vargas invited the community to participate the Brea Historical Society's commemoration of "The Big Game", celebrating the 100th anniversary of Babe Ruth and Walter Johnson playing baseball in Brea, on October 26 from 8:00 a.m. to 2:00 p.m. at the Brea Sports Park.
