REQUEST FOR FRANCHISE AGREEMENT RENEWAL WITH TESORO SOCAL PIPELINE COMPANY LLC

That the City Council: 1. Conduct a public hearing to consider granting an oil pipeline franchise to Tesoro Pipeline Company LLC; and,          2. Introduce an Ordinance of the City Council of the City of Downey Granting a Renewal of an Oil Pipeline Franchise Agreement to Tesoro Socal Pipeline Company LLC.

PUBLIC HEARING TO CONSIDER ADOPTION OF AN UNCODIFIED URGENCY ORDINANCE NO. 26-1541, EXTENDING A MORATORIUM ON SINGLE PRICE OVERSTOCK/DISCOUNT STORES FOR AN ADDITIONAL ONE (1) YEAR

That the City Council: Adopt Uncodified Urgency Ordinance No. 26-1541, extending a Moratorium on the approval, commencement, establishment, relocation, or expansion of Single Price Overstock/Discount Stores within City limits for an additional one (1) year.

This portion provides an opportunity for the public to address the City Council on agenda, consent calendar and items not listed on the agenda within the jurisdiction of the City Council. It is requested, but not required, that you state your name, address and subject matter upon which you wish to speak. The total public comment period is limited to 30 minutes. APPROVAL OF WARRANTS ISSUED

Warrant Nos. 398727 - 398925 (City) and 130 - 138 (CMSC); Payroll Wire Nos. 30004700; 30004706 - 30004707; 30004709 - 3004710; EFT Nos. 15909 - 15974 (City) and 50022 - 50025 (CMSC); and, Manual Wire Nos. 2820-2826; in the total amount of $4,833,009.46.

ACCEPTANCE OF WORK FOR THE DOWNEY AVENUE PAVEMENT REHABILITATION PROJECT, CAPITAL IMPROVEMENT PROJECT (CIP) NO. 23-03

That the City Council: 1. Accept the work for the Downey Avenue Pavement Rehabilitation Project, Capital Improvement Project (CIP) No. 23-03;   2. Approve Onyx Paving Company, Incorporated’s final construction contract amount of $3,034,813; and, 3. Authorize the Director of Public Works/City Engineer to file a Notice of Completion indicating the work is complete and has been accepted by the City.

ACCEPTANCE OF WORK FOR (1) BARBARA J. RILEY COMMUNITY CENTER PARKING LOT IMPROVEMENTS, CAPITAL IMPROVEMENT PROJECT NO. 23-17; (2) SOUTH ALLEY / PARKING LOT REHABILITATION AT WILDERNESS PARK, CAPITAL IMPROVEMENT PROJECT NO. 24-10; AND (3) CITY PARKING LOT IMPROVEMENTS, CAPITAL IMPROVEMENT PROJECT NO. 25-06

That the City Council: 1. Accept the work for the Barbara J. Riley Community Center, Capital Improvement Project (CIP) No. 23-17, South Alley / Wilderness Park, CIP No. 24-10, and City Parking Lot Improvements, CIP No. 25-06 Project; 2. Approve Pavewest, LLC’s final construction contract amount of $763,258; and, 3. Authorize the Director of Public Works/City Engineer to file a Notice of Completion for indicating the work is complete and has been accepted by the City.

DISCOVER DOWNEY BRAND UPDATE

That the City Council:  Receive and file an update on the refreshed Discover Downey brand.

8.

DISCUSSION REGARDING THE CITY OF DOWNEY CONSTRUCTION AND DEMOLITION DEBRIS DEPOSIT

That the City Council: 1. Discuss the current method for calculating Construction and Demolition debris deposits in the City; 2. Consider staff recommendations to reduce the percentage used in the calculation from 3 percent to 1.5 percent; reduce the minimum amount from $2,000 to $500; and create a maximum amount of $25,000 for deposits; and, 3. Direct staff to return with an ordinance to amend the Downey Municipal Code to reflect these changes.

9.

CITY OF DOWNEY COMPREHENSIVE GENERAL PLAN UPDATE STATUS REPORT

That the City Council: Receive and file a status report on the City’s Comprehensive General Plan update.

10.

CONSIDERATION OF AMENDMENT TO THE CITY OF DOWNEY CODE OF ETHICS AND CONDUCT

That the City Council: Consider amending the City of Downey Code of Ethics and Conduct governing members of the City Council and City Commissions, Committees, and Boards. This is a City Council-initiated action that is entirely within the City Council’s discretion and is therefore not accompanied by any staff recommendation.

In memory of Sergeant Theo K. Gekas, 55, Los Angeles County Sheriff's Department, who served at the Lakewood Sheriff's Station for over 20 years and succumbed to a long battle with cancer; and, retired Downey Fire Captain Ron McDearmon, who joined the Downey Fire Department in October 1966 as a firefighter and retired in 2001, serving the Downey community for nearly 35 years.
