PUBLIC HEARINGS

1.

ADOPTION OF A RESOLUTION APPROVING AND ADOPTING THE CITY OF DOWNEY WATER SYSTEM 2025 PUBLIC HEALTH GOALS REPORT

That the City Council: 1. Conduct a public hearing concerning the City of Downey Water System 2025 Public Health Goals Report; and, 2. Adopt Resolution No. 26-8361, approving and adopting the City of Downey Water System 2025 Public Health Goals Report.

PUBLIC COMMENT ON AGENDA, CONSENT CALENDAR, AND NON-AGENDA ITEMS

This portion provides an opportunity for the public to address the City Council on agenda, consent calendar and items not listed on the agenda within the jurisdiction of the City Council. It is requested, but not required, that you state your name, address and subject matter upon which you wish to speak. Please limit your comments to no more than three (3) minutes, unless otherwise limited by the Mayor for good cause including number of speakers, as permitted by the City’s meeting rules. The total public comment period is limited to 30 minutes. Pursuant to the Brown Act, no discussion or action, other than a brief response, referral to the City Manager/staff or schedule for a subsequent agenda, shall be taken by the City Council/Agency on any issue brought forth under this section.

APPROVAL OF COUNCIL MEETING MINUTES

APPROVAL OF WARRANTS ISSUED

Warrant Nos. 399525 - 399813 (City) and 144 - 147 (CMSC); Payroll Wire Nos. 30004716 - 20004718 and 30004720; EFT Nos. 16041 - 16082; Manual Wire Nos. 2833 - 2837, in the total amount of $4,560,500.67.

APPROVE PROFESSIONAL SERVICES AGREEMENT WITH CWE CORPORATION FOR DESIGN OF APOLLO PARK STORMWATER CAPTURE AND INFILTRATION IMPROVEMENTS, CAPITAL IMPROVEMENT PROJECT (CIP) NO. 23-23

That the City Council: 1. Approve a professional services agreement with CWE Corporation for a term of three years at an amount not to exceed $1,610,752 for design of Apollo Park Stormwater Capture and Infiltration Improvements, CIP No. 23-23; 2. Authorize the Mayor to execute the agreement; and, 3. Authorize the City Manager to execute any and all amendments to the agreement as deemed necessary within the approved project budget.

APPROVAL OF CONSTRUCTION CONTRACT FOR THE FOSTER ROAD AND CARFAX AVENUE STORM DRAIN IMPROVEMENTS (CIP) NO. 24-23

That the City Council: 1. Reject bids by OrangeBlue General Contractors and Oppenheimer National in the amounts of $409,790 and $417,398 as non-responsive; 2. Award a contract to CEM Construction Corporation in the amount of $427,900 for the construction of Foster Road and Carfax Avenue Storm Drain Improvements, CIP No. 24-23; and, 3. Authorize the City Manager, or his designee, to execute any change orders or additional scope of work for this project deemed necessary or desirable up to the approved project budget of $675,000.

APPROVAL OF SPECIFICATIONS AND AUTHORIZATION TO SOLICIT FOR BIDS FOR WELL NO. 2 REHABILITATION, CAPITAL IMPROVEMENT PROJECT (CIP) NO. 25-06, AND FIND THE PROJECT EXEMPT FROM THE CALIFORNIA ENVIRONMENTAL QUALITY ACT PURSUANT TO SECTION 15301(D)

That the City Council: Approve specifications and authorize solicitation for bids for Well No. 2 Rehabilitation, CIP No. 25-06, and further find that the project is exempt from the requirements contained in the California Environmental Quality Act (CEQA) under Section 15301(d).

7.

APPROVAL OF A PROFESSIONAL SERVICES AGREEMENT WITH CANNON, INC. FOR STRUCTURAL DESIGN SERVICES FOR THE FIRE APPARATUS STORAGE GARAGE PRE-ENGINEERED METAL BUILDING (PEMB)

That the City Council: 1. Approve a Professional Services Agreement with Cannon, Inc. in the amount of $111,750, for structural engineering services for the design of the Fire Apparatus Bay Garage Pre-Engineered Metal Building (PEMB); 2. Authorize the Mayor to execute the agreement; and, 3. Authorize the City Manager to execute any and all amendments to the agreement as deemed necessary.

8.

APPROVAL OF A PROFESSIONAL SERVICES AGREEMENT WITH THE DOWNEY PATRIOT FOR PUBLICATION OF LEGAL NOTICES

That the City Council: Approve a Professional Services Agreement with The Downey Patriot in an amount not to exceed $75,000, for the publication of legal notices for the period beginning July 1, 2026 through June 30, 2027.

APPROVAL OF FULFILLMENT AGREEMENT BETWEEN THE CITY OF DOWNEY AND THE LOS ANGELES COUNTY METROPOLITAN TRANSPORTATION AUTHORITY (LACMTA) FOR UNPROGRAMMED SURFACE TRANSPORTATION PROGRAM-LOCAL (STP-L) FUNDS

That the City Council: 1. Authorize the City Manager to enter into an agreement with the LACMTA for the unprogrammed STP-L funds converted to Prop C funds to be used for street rehabilitation projects; and, 2. Appropriate $339,952 in Prop C funds into the Bellflower Pavement Rehabilitation Project (54-1-6712-0520).

SECOND READING AND ADOPTION OF AN ORDINANCE APPROVING ZONING TEXT AMENDMENT OF THE DOWNEY MUNICIPAL CODE REGULATING VARIOUS SECTIONS OF ARTICLE IX (LAND USE)

That the City Council: Adopt Ordinance No. 26-1543, approving a Zoning Text Amendment (PLN-26-00019) amending Article IX of the Downey Municipal Code, a City-initiated Zoning Text Amendment relating to various sections of the Downey Municipal Code.

SECOND READING AND ADOPTION OF AN ORDINANCE APPROVING A ZONING TEXT AMENDMENT OF THE DOWNEY MUNICIPAL CODE REGULATING ACCESSORY DWELLING UNITS AND JUNIOR ACCESSORY DWELLING UNITS

That the City Council: Adopt Ordinance No. 26-1544, approving a Zoning Text Amendment (PLN-26-00036) amending Article IX of the Downey Municipal Code relating to Accessory Dwelling Units and Junior Accessory Dwelling Units.

DRONE ENFORCEMENT OF ILLEGAL FIREWORKS VIOLATIONS AND DISCUSSION OF POTENTIAL ORDINANCE AMENDING THE DOWNEY MUNICIPAL CODE TO HOLD PROPERTY OWNERS ACCOUNTABLE FOR UNLAWFUL FIREWORKS USED OR FOUND ON THEIR PROPERTY

That the City Council: 1. Receive information concerning the proposed deployment of drones by the Downey Police Department during the upcoming Independence Day period to more accurately identify locations where illegal fireworks are being discharged and to help detect, record, and document violations from the air; and, 2. Discuss whether to amend the Downey Municipal Code to impose liability on property owners if illegal fireworks are used or found at their property even if they did not light or otherwise permit them.

In memory of Judy Shirley, 78, longtime Downey resident, former member and volunteer at Trinity Lutheran Church, who served as the current Membership Chairman of the Assistance League of Downey, who passed away following a tragic vehicle collision in Kingman, Arizona.
