The City Council met in a regular session on Tuesday, October 10, 2023, at 5:00 p.m. in the City Council Chamber of the Civic Center, 6650 Beach Boulevard, Buena Park, California, Mayor Brown presiding.

The Invocation was led by Dr. Joel Val Soelen, Anaheim Christian Reformed Church.

2. PRESENTATIONS

2.A. AWARD OF MERIT PRESENTED TO BUENA PARK POLICE DEPARTMENT LIEUTENANT JOHN BAILEY

Police Chief Nunes presented an Award of Merit to Buena Park Police Department Lieutenant John Bailey.

Fourth District Supervisor Doug Chaffee, and legislative representatives on behalf of federal, state, county, and local legislators presented commendations to Lieutenant John Bailey.

Mayor Brown announced the public may at this time address the members of the City Council on any matters within the jurisdiction of the City Council. There being none, Mayor Brown closed oral communications.

4. NEW BUSINESS

4.A. COMMENDATIONS TO OUTGOING MAYOR BROWN

Mayor Pro Tem Sonne thanked outgoing Mayor Brown for his service, leadership, and dedication as Mayor.

Senator Tom Umberg, Fourth District Supervisor Doug Chaffee, NOCC President/CEO Andrew W. Gregson, and legislative representatives on behalf of federal, state, county, and local legislators presented their commendations to outgoing Mayor Brown.

At 5:32 p.m., Mayor Brown called for a recess.

At 5:40 p.m., Mayor Brown reconvened the meeting.

4.B. COMMENTS BY OUTGOING MAYOR BROWN

Outgoing Mayor Brown spoke in reflection of his service as Mayor and thanked his fellow Council Members, Department Heads, City staff, and residents for the support.

4.C. SELECTION OF MAYOR

Director of Government and Community Relations/City Clerk Jimenez explained the process for the selection of Mayor and opened nominations.

Council Member Brown nominated Mayor Pro Tem Sonne for the position of Mayor. There being no further nominations, Mayor Pro Tem Sonne was selected as Mayor.

City Clerk Jimenez turned the meeting over to Mayor Sonne.

4.D. SELECTION OF MAYOR PRO TEM

Mayor Sonne opened nominations for the position of Mayor Pro Tem.

Mayor Sonne nominated Council Member Ahn for the position of Mayor Pro Tem. There being no further nominations, Council Member Ahn was selected as Mayor Pro Tem.

4.E. PROFESSIONAL SERVICES AGREEMENT WITH DUDEK FOR PREPARATION OF A CLIMATE ACTION AND ADAPTATION PLAN

Director of Community and Economic Development Foulkes provided a report regarding an approval of a Professional Services Agreement With DUDEK for the preparation of a Climate Action and Adaptation Plan. Director Foulkes explained the purpose of a Climate Action and Adaptation Plan (CAAP). It includes actionable strategies the City will implement to both reduce greenhouse gas (GHG) emissions and address climate change impacts by adapting to and building resilience of the City's assets and operations. Buena Park's CAAP will focus on the reduction of GHG emissions in the construction, energy, transportation, and waste sectors. The City released a Request for Proposals (RFP) to seek professional consultant services to develop a comprehensive and innovative CAAP. The City received ten proposals; interviewed the top five consultants; and, at the end, the review team recommended the City award a Professional Services Agreement to DUDEK to partner with the City to prepare the CAAP. The 11-month process will include public participation and engagement to bring people, communities and businesses to the table to address concerns and hear suggestions from multiple stakeholders; assess needs, risks, and vulnerabilities; define community goals; identify preferred GHG reduction measures; and coalesce around common purposes. Additionally, the consultant team will conduct engagement efforts across City Departments, City Council, City Commissions, and regional bodies. If approved, the project kick-off is scheduled for January/February 2024 to coincide with the hiring of the City's Sustainability Manager position who will be the lead project manager for the CAAP development and implementation.

Council Member Castaneda suggested that the City look into SCAG's free technical assistance for greenhouse gas omission inventory.

Director of Government and Community Relations/City Clerk Jimenez acknowledged the email correspondence received in support of the item from Marilyn Palomino, Jake Comer, and Denise Fachko.

Tomas Castro, Climate Action Campaign Policy Advocate, spoke in support of the award of professional services agreement with Dudek for the preparation of a Climate Action and Adaptation Plan, and how moving forward with this effort will allow for numerous funding opportunities for Buena Park in the future.

Council Member Brown commented about the timeliness of putting together the CAAP.

Council Member Traut commended the City Council for the political courage to discuss about climate action and ensure that the City strives to reduce gas emissions and prepare for climate change impacts.

Council Member Castaneda spoke about a partnership with SoCal Edison for all electric reach codes as part of the climate action planning effort.

MOTION CARRIED to approve the recommended action.

MOTION Jose Trinidad Castaneda, SECOND Joyce Ahn, and VOTED 5-0-0-0-0 to approve the recommended action.

5. CONSENT CALENDAR

Mayor Sonne announced that Consent Calendar Item Nos. 5A through 5J would be acted upon by one motion affirming the actions as recommended on the agenda and agenda bills submitted and inquired if anyone present desired to have any item removed for separate consideration. Council Member Castaneda requested for separate consideration on Item No. 5G. There being no additional requests for separate discussion, the following action was taken:

MOTION Joyce Ahn, SECONDED, Art Brown and VOTED 5-0-0-0.

MOTION CARRIED that all actions recommended on Consent Calendar Item Nos. 5A - 5F and 5H - 5J be approved.

5.A. RESOLUTIONS APPROVING CLAIMS AND DEMANDS

APPROVED the recommended action.

5.B. TREASURER'S REPORT FOR THE MONTH OF OCTOBER 2023

APPROVED the recommended action.

5.C. RESOLUTION AUTHORIZING AND DIRECTING CERTAIN BANKS TO HONOR ALL CHECKS, DRAFTS, AND WARRANTS WHEN BEARING CERTAIN SIGNATURES AND FACSIMILE SIGNATURES OF CITY OFFICIALS AND RESCINDING ALL CONFLICTING RESOLUTIONS

APPROVED the recommended action.

5.D. AGREEMENT WITH ORANGE COUNTY SHERIFF’S DEPARTMENT (OCSD) TO TRANSFER FUNDS RELATED TO THE 2023 EDWARD BYRNE MEMORIAL JUSTICE ASSISTANCE GRANT (JAG) PROGRAM FOR SUPPLEMENTAL FUNDING FOR THE LEASING OF FLOCK AUTOMATED LICENSE PLATE READER (ALPR) TECHNOLOGY

APPROVED the recommended action.

5.E. FINAL PAYMENT FOR THE ORANGETHORPE AVENUE REHABILITATION PROJECT

At 6:09 p.m., Mayor Sonne reopened public comment.

Dave Everett, Western Electrical Contractors Association, spoke about City Council's consideration of bidding future projects without adhering to the CWA.

APPROVED the recommended action.

5.F. FINAL PAYMENT FOR THE 2021-2022 AND 2022-2023 SEWER MAIN LINING PROJECT

APPROVED the recommended action.

5.G. AMENDMENT NO. 1 TO PROFESSIONAL SERVICES AGREEMENT WITH ECONOMICS, INC. FOR SB 1383 PROGRAM SUPPORT AND OUTREACH

Senior Management Analyst Aubuchon discussed the amendment to the Professional Services Agreement (PSA) with EcoNomics, Inc. for SB 1383 Program support and outreach. Since July of 2022, EcoNomics, Inc. has designed and implemented the City's SB 1383 Program, including developing an outreach and education program, a recordkeeping program, and facilitating relationships with edible food producers and edible food recovery organizations. There remains a high rate of non-compliance of Tier 1 and Tier 2 food generators. Therefore, the City desires to have EcoNomics, Inc. continue its outreach and notifications prior to enforcement starting January 1, 2024. The proposed amendment to the original PSA will extend EcoNomics, Inc.'s budget to include fees for services for November and December 2023 in the amount of $9,930.

Council Member Castaneda commented about making an effort to have all businesses in Buena Park receive the same amount of information about the SB 1383 Program.

Director of Government and Community Relations/City Clerk Jimenez thanked outgoing Mayor Brown for his service and indicated she is looking forward to working with him in his last year as a Council Member. Director Jimenez also thanked newly selected Mayor Sonne for her leadership and guidance in the previous year and she is looking forward to her year as Mayor.

Director Jimenez announced a vacancy on the Navigation Center Oversight Commission. Residents interested in applying for the position could contact Council Member Traut.
