7. Citizens to be Heard
This is the only time during the Council Meeting that a citizen can address the City Council. It is the opportunity for visitors and guests to address the City Council on any issue to include agenda items. All visitors wishing to speak must fill out the Sign-In Roster prior to the start of the meeting. City Council may not deliberate any non-agenda issue, nor may any action be taken on any non-agenda issue at this time; however, City Council may present any factual response to items brought up by citizens. (Attorney General Opinion - JC-0169) (Limit of three minutes each.) All remarks shall be addressed to the Council as a body. Remarks may also be addressed to any individual member of the Council so long as the remarks are (i) about matters of local public concern and (ii) not disruptive to the meeting or threatening to the member or any attendee including City staff. Any person violating this policy may be requested to leave the meeting, but no person may be requested to leave or forced to leave the meeting because of the viewpoint expressed. Citizens who want to submit written comments to be read during the citizen comments portion of a city council meeting should include their name, address and reason why they are unable to attend the meeting at which they want their comments read. Comments must be submitted to the City Secretary at citysecretary@cibolotx.gov no later than 2:00PM prior to the City Council meeting. All comments received that include the required information will be provided to the Mayor and Council and may be summarized or read at the meeting at the discretion of the presiding officer. This meeting is livestreamed.

The City Council will meet in Executive Session as Authorized by the Texas Gov’t Code Section 551.071, Consultation with Attorney, and Section 551.074 Personnel Matters, to discuss the following:
11.A. Discussion on the Grand Prairie vs. State of Texas lawsuit.
11.B. Discussion, pursuant to 551.074 (Personnel Matters), regarding the duties and responsibilities of the City Manager per Section 3.07 of the City Charter, regarding Fire Apparatus Operator, Fire Chief and the application of personnel policies and how the application of policies may affect department operations, including the appropriate use of City property.
11.C. Discussion regarding the duties and responsibilities of the City Attorney.

Reconvene into Regular Session and take/or give direction or action, if necessary, on items discussed in the Executive Session.
13. Resolutions
13.A. Approval/Disapproval of a Resolution by the City Council of the City of Cibolo, Texas ratifying a resolution for a grant application to the Office of the Governor for the Cybersecurity Grant Planning Project and designating an authorized official. (Mr. Beekman)
14. Discussion/Action
14.A. Discussion/Action to consider a Petition for Release of Area from the City of Cibolo, Texas, Extraterritorial Jurisdiction (ETJ) of two tracts of land totaling 23.329 acres, located in the Pedro San Miguel Survey Number 256, generally located at 5711 Green Valley Road, known as Ortiz tract.
14.B. Discussion/Action to approve a Professional Services agreement with Kimley-Horn for the Preliminary Engineering and Schematic Design of Wiedner Road Expansion (Town Creek/Bentwood Pass to FM1103) and authorize the City Manager to execute the agreement in amount not to exceed $1,394,855 (Mr. Al Haddad)
14.C. Discussion/Action to approve a Professional Services Agreement with Kimley-Horn for the Citywide Pavement Condition Index (PCI) Study base bid in an amount not to exceed $151,535, with consideration of add alternates for a total amount not to exceed $249,094, and authorize the City Manager to execute the agreement (Ms. Hernandez)
14.D. Discussion/Action to authorize the City Manager to execute a Purchase Order with Closner Equipment Co., Inc. for the purchase of a new Carlson CP85 Commercial Paver in the amount of $283,666.54. (Ms. Hernandez)
14.E. Discussion/Action to authorize the City Manager to execute a Purchase Order with Motorola Solutions for the purchase of fifty (50) Police APX NEXT ALL BAND Radios and sixteen (16) Fire APX NEXT XN Signal Band Radios in the amount of $748,247.00. (Chief Andres & Chief Troncoso)
14.F. Discussion/Action regarding written consent and authorization for the City Attorney to represent the City of Cibolo regarding the Cibolo Valley Local Government Corporation (CVLGC) Management of Assets and authorize the City Manager to execute the attached letter.

This agenda has been approved by the city's legal counsel and subject in any Executive Session portion of the agenda constitutes a written interpretation of Texas Government Code Chapter 551. This has been added to the agenda with the intent to meet all elements necessary to satisfy Texas Government Code Chapter 551.144.
