1. Call to Order
1.A. Call to Order- 7:55 PM
Mayor Dupper Called to Order the Housing Authority Meeting at 7:55 PM for the Joint Public Hearing with the City Council to discuss the Sale and Transfer of property within the Affordable Housing Program located at 25615 Prospect Avenue (HA Item No. 2A). Discussion concluded at 7:59 PM. The City Council reconvened to the City Council Meeting agenda at 7:59 PM.
1.B. Roll Call- 7:55 PM
Staff Present:
The Housing Authority Board reconvened the Housing Authority Meeting at 8:32 PM.
The City Attorney informed the Housing Authority Board that she wanted to add an item to the Closed Session pertaining to existing litigation [Government Code 54956.9(d)(1)] Ditech Financial, LLC v. City of Loma Linda Housing Authority. She was informed this week of a court hearing date this month pertaining to the case. She wanted to discuss the details of the case to the Board before the court date. Because the court date is this month, she noted that there was an immediate need to add to the agenda and that the agenda was already posted when she was informed of this information.
City Attorney Robbins advised that, in order to add the item to the agenda, the Board must make a motion that must pass with a 4/5 vote, determining the following findings:
Motion by Rhodes Rigsby, seconded by Bhavin Jindal, and the motion carried by a vote of 5-0-0-0 to add the item of discussion to the closed session, based on the findings that 1) there was an immediate need to take action based on the scheduled court hearing date this month on the above-noted case, and 2) the matter came to staff's attention after the City Council Agenda was posted.
The Housing Authority Board recessed at 8:38 PM for Closed Session.

Closed session conference with Legal Counsel regarding Existing Litigation [Government Code 54956.9(d)(1)] Name of Case: Ditech Financial, LLC v. City of Loma Linda Housing Authority.
The Housing Authority Board reconvened at 8:52 PM.
City Attorney Robbins announced the Housing Authority Board met in Closed Session. She discussed the case with the Board Members and received direction from the Board. No further action to report.

2.A. Joint Public Hearing - Sale and Transfer of 25615 Prospect Avenue- 7:55 PM
Mayor Dupper Called to Order the Housing Authority Meeting at 7:55 PM for the Joint Public Hearing with the City Council to discuss the sale and transfer of 25615 Prospect Ave.
City Manager Thaipejr presented the report into evidence stating that the property at 25615 Prospect Avenue is part of the Housing Affordability Program; and that the owners who purchased the property in 2014 anticipated a job transfer to another state facilitating the sale and transfer of the property to a program qualified family. He noted the City's Housing Consultant and Housing Attorney reviewed the qualifying applications and selected the most qualified buyer. The buyers agreed to the terms and conditions in the Assumption Agreement and the affordability covenants to which the property is subject. The buyers will be assuming the responsibilities outlined in the attached Agreement.
The joint public hearing was opened and closed with no public participation at 7:57 PM.
Motion by Ronald Dailey, seconded by Bhavin Jindal, passing by a vote of 5-0-0-0-0,
the sale and transfer of 25615 Prospect Street to Juan and Christina Sanchez per the terms and conditions outlined in the Assumption Agreement; and to Adopt Council Bill #R-2023-37, presently known as, RESOLUTION 3199 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LOMA LINDA CONSENTING TO THE APPROVAL BY THE LOMA LINDA HOUSING AUTHORITY OF AN AGREEMENT FOR THE DISPOSITION OF PROPERTY FOR AFFORDABLE HOUSING USE WITH JUAN SANCHEZ AND CHRISTINA SANCHEZ. The City Council reconvened to the City Council Meeting agenda at 7:59 PM.
